Subject : Used Car advice! Do i have rights?
HI
Yesterday i swapped my beautiful ford focus 1.8 for a 1.4 peugeot 206. My only reasons for doing this was to try and save some money as its costing a lot to run with the petrol prices. taxes etc. So i went to various garages and got told my focus was only worth maximum 2k....and the only cars i got pffered were crap ones! .i paid 3,700 6 months ago. Eveentually i got offered the peugot that was up at 3k so thought i was getting a good deal. Same age, same miles etc....the dealer said i could do a straight swap and just pay the tax on the new one.
Well i have been driving it today and i HATE it!! I really want my focus back. I know i did it for economy resons but i really regret getting rid of my focus!! Do i have any right to go back to the garage and say i changed my mind? The guy there knew i wasn't happy about it when i signed the papers. Also they have now got it up for sale at 3495!!
Does anyone know where i stand on swapping back?

have you read the small print on the contract? Do you have any cooling period? To be honest, if the garage sold your car this afternoon for example, it won't be possible.

Hmmm I have no idea as iv never been in the situation but understand how you feel. In regards the the value of the Focus unfortunatly they dont take milage into condsideration anymore and its all about the age of the Car now. i know this hasnt helped much but at least it will bump your post back up.

You have no legal reason to swap back just because you change your mind unless there is some very generous clause in your contract but I doubt there is.
Sorry but I don't think there is anything you can do. You got what you contracted for and the garage is entitled to sell the Focus for what it wants.

I understand that the garage would always sell it for more than they offered me, its not the price thats bothering me, i just love the car and after driving the peugeot today its made me just hate everything about itand miss my car even more!
I dont have a contract as such, just an invoice. I really really want it back!!!

Didn't they offer you a test drive? How long ago did you do the swap..... they can't sell yours until they've done the paperwork as the new registered owners. Go onto parkers website, glasses index or autotrader.... they have a search engine where you imput your car details and it tells you how much it's worth... the garages go by the glasses index!
find out if you've been ripped off for the valuation of your own car. Why don't you phone the garage and ask..... if you didn't have a test drive then that's sufficient grounds to take it back I would think!

Yeah i had a test drive but for literally 5 mins and it was at 5.30 pm so u can imagine the traffic....not really a proper test drive. I'm just gonna have to bite the bullet and ring them tomorrow. I tried earlier but it was a different bloke. He said if the log book has been sent off then its too late, but i have the bit out of the log book that says i sold it to a trader. He said i had to post that off so as i haven't done that yet, am i still the registered owner?

yeah, because the reason your supposed to send that ASAP is so that you don't have the responsibility if it goes through a speed camera etc. Although you will have signed their copy saying you've sold it to them, so if the DVLA have that copy, then it might scupper things for you. To be honest I don't think they'll swap it back for you because they got the better deal and might want you to buy it back from them! But I would be arsey about the test drive and say it wasn't sufficient and the car doesn't handle as well as your old one, you're not as comfortable driving it, you're not saying there's anything wrong with the peugot, but you weren't given sufficient opportunity to gauge what you were buying! bla bla bla.
