Hi, can anyone help? I was due to get married this month but unfortunately my partner and I split up. My dress is still at the Caroline Castigliano shop ready for collection. He says he wants the dress and that it is legally his, as he paid for it, but I have signed the sales contract. I know this is an unusual one, but does anyone know who the dress legally belongs to??

It is possible to argue it was a gift but realistically it is likely to be a conditional gift - a dress for you to wear on your wedding day is probably a gift conditional on the wedding taking place. I think it is very very unlikely that a Court would say that you should keep a dress intended for a wedding that didn't happen and that you haven't paid for. Sorry, but that is the legal position in my view.

give him the dress and tell him you hope he looks pretty in it!

I would say it legally belongs to you as it was a gift also if you paid in cash he has no way of proving he did actually pay for it. just contact the shop and tell them you don't want him picking it up which I'm sure they wouldn't do anyway.

On the basis of what you have written above, if he paid for it, it's his. Let him keep it and be grateful you haven't wasted your own money.
